Pretty sure they didn't trademark Ink or Sink previously so I am sure Nintendo would win that case for a frivolous lawsuit. I think it is just coincidence.

It want really a name change, and Nintendo didn't know about ink or sink until after the JP upload of this song (through the email), which shared the name.

The song was originally uploaded with that name to NOJ's channel on July 21st. The first post of the Ink or Sink Tournament was on July 27th. It's impossible for Nintendo to have copied it. If there is a connection, it's the other way around.
